I agree, it is an interesting concept. In German, a possible term would be "Maluspunkte".

Maybe like time in the penalty box in hockey? High-sticking is more dangerous but give the scammer 5 minutes in the penalty box and get him off the ice.

Yes, good idea. Let's give them 5 minutes for a major penalty, like charging. Charging to much that is. Or a misconduct penalty if they are too sloppy.
